Biological width violation

I had a crown put on in January and it has been hurting ever since. The dentist sent me to an endodontic place and they said I don't need a root canal. He took off the permanent crown and put on a temporary. I still have the same symptoms. He sent me back to the endodontic place and they said my biological width is violated and I need crown lengthening. Should the dentist pay for that procedure because he didn't respect the biological width?

If the biological width was violated during the crown prep, it’s considered a clinical error. In that case, the dentist should ideally take responsibility, including covering the cost of crown lengthening.

That crown is very deep down, but how did the tooth like prior to the crown placement? Need an idea of what the dentist had to work with initially.
